1. Introduction and Acceptance
1.1 These Terms and Conditions ("Terms") govern access to and use of the website revscheckreport.au ("Website") and the purchase of REVS check / PPSR vehicle history reports ("Reports") provided through the Website.
1.2 By accessing the Website, browsing its content, or purchasing a Report, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Website or purchase a Report.
1.3 These Terms, together with the Disclaimer and Privacy Policy published on the Website, form the complete agreement between you and Eprotech Pty Ltd (ABN: 43 644 335 535 / ACN: 644 335 535) ("we," "us," "our," or "Company") regarding your use of the Website and purchase of Reports.
1.4 You must be at least 18 years of age, or otherwise have the legal capacity to enter into a binding contract under Australian law. By using the Website or purchasing a Report, you represent and warrant that you meet this requirement.
1.5 We reserve the right to update these Terms at any time. Changes will be published on this page with an updated "Last updated" date. Your continued use of the Website after changes are published constitutes your acceptance of the updated Terms.
1.6 This agreement is formed electronically in accordance with the Electronic Transactions Act 1999 (Cth) and the Electronic Transactions Act 2000 (NSW). A transaction is not invalid merely because it was conducted by electronic communication.
2. Services and Products
2.1 The Website provides digital vehicle history reports (Reports) based on information you provide and data accessed from the Australian Personal Property Securities Register (PPSR) and related government data sources (such as NEVDIS) for motor vehicles registered or ordinarily located in Australia.
2.2 Reports are sold at a price of $2.00 AUD per report (or as otherwise displayed on the Website at the time of purchase). The PPSR itself charges $2.00 per search.
2.3 A Report typically includes key information drawn from an official PPSR search certificate issued under section 174 of the Personal Property Securities Act 2009 (Cth) and related government data (such as NEVDIS data), including:
(a) Whether any security interest or finance owing is recorded against the vehicle, including PPSR registration details where applicable.
(b) Basic vehicle identifiers and descriptors (such as VIN, make, model, body type, and year of manufacture/compliance where available from data sources).
(c) Whether the vehicle is recorded as written off, and any available written-off vehicle details returned by the register.
(d) Whether the vehicle is recorded as stolen, and any available stolen status information returned by the register.
(e) PPSR search details including search type, search reference number, search date and time, and other search reference information returned by the register.
2.4 The exact contents of a Report may vary depending on:
(a) The information you provide (such as VIN, registration number, and state).
(b) What is recorded or not recorded on the PPSR and other relevant databases at the time of the search.
(c) Any limitations, omissions, delays, or errors in those external databases.
2.5 Important: Reports are based on data returned at the time of the search and are provided for information purposes only. Reports do not constitute legal, financial, or mechanical advice, and they are not a substitute for:
(a) A professional mechanical inspection of the vehicle.
(b) Independent legal advice about title, ownership, or encumbrances.
(c) Independent financial advice if you are financing the purchase.
You should obtain independent professional inspections and advice before purchasing any used vehicle. Do not rely solely on Reports when making purchasing decisions.
2.6 Reports are delivered electronically via:
(a) On-screen display immediately after purchase (subject to system availability); and/or
(b) Email (such as a PDF, link, or access instructions) to the email address you provide.
2.7 Delivery times are typically within minutes of completing payment but may be delayed due to:
(a) System maintenance or updates.
(b) Technical failures or network issues.
(c) External system delays or unavailability (such as PPSR, NEVDIS, or other government database outages).
(d) High demand or server load.
No guarantee of delivery within any specific timeframe is made.
3. User Obligations
3.1 When using the Website or requesting a Report, you agree to:
Provide accurate, complete, and truthful information (including VIN, registration number, and state).
Use the Website and Reports only for lawful purposes related to your own vehicle purchase or evaluation.
Not use Reports to engage in fraud, harassment, deception, or illegal activity.
Not attempt to bypass, hack, or disrupt the Website's security or systems.
Verify that the Report returned relates to the correct vehicle before relying on it or making purchasing decisions.
3.2 If you create an account, you are responsible for:
Maintaining the confidentiality of your username and password.
All activity that occurs under your account.
Notifying us immediately of any unauthorised access or use of your account.
3.3 You must not:
Reproduce, republish, resell, or distribute Reports without our written permission.
Use Reports for commercial purposes (such as reselling them to third parties).
Extract, scrape, or systematically collect data from the Website.
Create automated tools or bots to access the Website.
Attempt to reverse-engineer or access PPSR or government databases directly through our systems.
4. Pricing, Payment, and Delivery
4.1 Pricing: All prices are displayed in Australian dollars (AUD). The current price for a Report is $2.00 AUD. Prices include GST where applicable. GST is added at checkout and itemised on your receipt.
4.2 Payment Methods: Payment is processed securely through:
Stripe (credit cards, debit cards, and other supported payment methods).
PayPal (PayPal account or cards linked to PayPal).
4.3 Payment Processing:
A purchase is deemed complete when payment is successfully processed by Stripe or PayPal.
You will receive a confirmation email with a transaction receipt.
Full credit card details are not stored by us; they are handled securely by Stripe or PayPal in accordance with the Payment Card Industry Data Security Standard (PCI DSS).
4.4 Delivery:
Reports are typically delivered within minutes of successful payment.
You will be able to view your Report on-screen and receive a copy by email.
Delivery times may vary due to system availability, external system processing delays, and PPSR or government database response times.
4.5 Failed Payments: If your payment fails, the purchase will not be completed and you will not be charged. You may retry payment or contact us for support.
5. Refunds and Australian Consumer Law
5.1 Digital Goods Policy: Once a Report has been successfully generated and delivered to you, it is considered a digital product that has been supplied and cannot be returned, resold, or transferred. For this reason, change-of-mind refunds are not offered after delivery.
5.2 Refunds for System Errors: A refund may be issued if:
The Report failed to generate or was not delivered due to a system error on our part.
The Report contains a major fault (such as returning data for the wrong vehicle due to a system error, not user input error).
You provided correct information but received no usable Report due to our system failure.
Payment was processed but no Report was generated or delivered within a reasonable timeframe (typically 24 hours) due to our system failure.
To request a refund for a system error, contact us within 14 days of purchase with supporting details (including your transaction reference number and a description of the issue).
5.3 No Refund for Input Errors: Refunds are not offered if you provided incorrect information (such as a wrong VIN, incorrect registration number, or wrong state) and received a Report for a different vehicle or no results. You are responsible for:
Entering correct vehicle details.
Verifying that the Report relates to the correct vehicle before relying on it.
Double-checking your input before submitting a search request.
If you are unsure of the correct VIN or registration details, verify them with the vehicle seller or relevant registration authority before purchasing a Report.
5.4 No Refund for PPSR/Government Database Content: Refunds are not offered based on the content of PPSR or government database results, including if:
The Report shows no registered encumbrances, but you later discover undisclosed issues.
The Report shows registered encumbrances, written-off status, or stolen status that you were not expecting.
PPSR or government database information changes after you receive the Report.
You disagree with or are dissatisfied with information recorded in PPSR or government databases.
Data is retrieved and presented exactly as it appears in PPSR and government systems at the time of the search. The content of those databases is not controlled, verified, or altered by us. If you believe information in PPSR or government systems is incorrect, contact the relevant authority directly (such as the Australian Financial Security Authority for PPSR matters).
5.5 Australian Consumer Law Guarantees: Nothing in these Terms excludes or limits your rights under the Australian Consumer Law, set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth). Consumer guarantees are automatic and cannot be excluded or modified by contract.
If Reports fail to meet consumer guarantees (such as being of acceptable quality, fit for purpose, or provided with due care and skill), you may be entitled to a refund, repair, or replacement. Examples include:
If a Report is not delivered due to our fault, you may be entitled to a refund.
If a Report contains major errors due to our system failure (not PPSR data limitations), you may be entitled to a refund or resupply.
If we engage in misleading or deceptive conduct, you may have additional rights under the ACL.
If you believe a Report does not meet consumer guarantees, contact us with details of the issue. An investigation will be conducted, and a remedy (such as resupply of the service or refund of the price paid) may be offered to the extent required by law.
5.6 Chargeback and Dispute Process: If you dispute a charge through your bank, credit card provider, or PayPal, we will cooperate with the dispute process and provide evidence of service delivery. Frivolous, dishonest, or vexatious disputes may result in suspension of your account and referral to debt collection or legal action.
6. Intellectual Property
6.1 All content on the Website, including text, graphics, logos, layout, branding, Report format, and presentation ("Content"), is owned by or licensed to Eprotech Pty Ltd. Unless otherwise stated, all rights are reserved.
6.2 You are granted a limited, non-exclusive, non-transferable licence to:
View and download Reports you have purchased for your personal, non-commercial use.
Use Reports to evaluate a vehicle you are considering purchasing.
Provide a copy of the Report to your legal or financial advisor for the purpose of obtaining advice.
6.3 You must not:
Reproduce, modify, publish, or distribute Reports or Website Content without our written permission.
Remove or alter any copyright, trademark, or other intellectual property notices.
Use Reports or Content for any commercial purpose (including reselling Reports or incorporating them into commercial products).
Resell, license, or transfer your licence to others.
Create derivative works based on Reports or Website Content.
6.4 Any unauthorised use of intellectual property may infringe our rights and expose you to legal action, including claims for damages and injunctive relief under the Copyright Act 1968 (Cth) and other applicable legislation.
7. Disclaimers and Limitation of Liability
7.1 Information Accuracy: Reports are generated using data from PPSR, NEVDIS, and other government and third-party data sources, which may contain errors, delays, omissions, or outdated information. While reasonable steps are taken to retrieve and present this information accurately, no guarantee is made that Reports are complete, error-free, or up-to-date.
We act as an intermediary to retrieve and present data from PPSR and government systems. The content of those databases is not controlled, verified, or altered. If you believe information in a Report is incorrect, verify it directly with the relevant authority.
7.2 Service Availability: The Website is provided on an "as is" and "as available" basis. No guarantee is made regarding:
Uninterrupted or error-free operation.
That any defects or errors will be corrected.
That the Website or Reports will be available at all times.
That PPSR, NEVDIS, or other government systems will be available or responsive when you request a Report.
7.3 Limitation of Liability: To the maximum extent permitted by law, we are not liable for:
Any indirect, incidental, special, consequential, or punitive loss or damage.
Loss of profit, revenue, opportunity, data, or goodwill.
Any loss or damage arising from delays, errors, or unavailability of the Website, Reports, PPSR, NEVDIS, or other external systems.
Any loss or damage arising from use of or reliance on Reports or Website content.
Any loss or damage arising from third-party services or providers (including payment processors, hosting providers, PPSR, or government systems).
Any loss or damage arising from your input errors or failure to verify information.
Any loss or damage arising from errors, omissions, or delays in PPSR, NEVDIS, or government database records.
Any loss or damage arising from purchasing a vehicle based on information in Reports.
7.4 Non-Excludable Guarantees: Nothing in these Terms excludes or limits any non-excludable consumer guarantees under the Australian Consumer Law. To the extent the law allows, our liability for breach of such guarantees is limited to:
(a) The cost of resupply of the services; or
(b) Refund of the price paid for the Report.
7.5 Your Responsibility: You are responsible for:
Providing accurate information when requesting a Report.
Verifying that the Report relates to the correct vehicle.
Obtaining independent professional mechanical inspections, legal advice, and financial advice before purchasing a vehicle.
Making your own purchasing decisions based on all available information, including but not limited to Reports.
Independently verifying important information (such as finance owing, written-off status, or stolen status) before completing a vehicle purchase.
8. Privacy and Data Protection
8.1 Personal information is collected, used, stored, and disclosed in accordance with our Privacy Policy, which complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
8.2 By using the Website and purchasing a Report, you consent to the collection and use of your personal information as described in the Privacy Policy.
8.3 Information collected may include:
Your name, email address, and contact details.
Vehicle search details (VIN, registration number, state).
Payment details (handled securely by Stripe or PayPal — we do not store full credit card numbers).
Website usage data collected through analytics tools.
8.4 Personal information will not be sold to third parties. Information may be shared with third-party service providers (such as payment processors and government databases) only as necessary to deliver Reports and operate the Website.
8.5 You have the right to access and correct your personal information. To make a request, contact us using the details in Section 14.
9. Website Availability and Changes
9.1 We reserve the right to modify, suspend, or discontinue any part of the Website, Reports, or services at any time, with or without notice.
9.2 Continuous or uninterrupted access to the Website is not guaranteed. The Website may need to be taken offline for:
Maintenance, updates, or repairs.
Technical issues or security concerns.
External factors such as internet outages, PPSR or government database unavailability, or third-party service disruptions.
9.3 Reasonable efforts will be made to minimise downtime and notify users of scheduled maintenance where practicable.
9.4 We are not liable for any loss or damage you suffer as a result of Website unavailability, service interruption, or inability to access PPSR or government databases.
10. Third-Party Services and Links
10.1 The Website uses third-party services and may contain links to external websites, including:
Payment processors: Stripe and PayPal handle all payment processing.
Government databases: PPSR (operated by the Australian Financial Security Authority) and NEVDIS (operated by state/territory transport authorities) are accessed on your behalf.

11. Termination and Suspension
11.1 We reserve the right to suspend or terminate your access to the Website, or your account, if:
You breach these Terms, our Disclaimer, or our Privacy Policy.
You use the Website for unlawful purposes or in a manner that harms us or other users.
We suspect fraudulent, abusive, or vexatious activity.
You attempt to reverse-engineer, hack, or disrupt our systems.
You are in serious or repeated breach of these Terms.
11.2 Suspension or termination may occur without notice if it is necessary to protect the Website, systems, or other users.
11.3 If your account is suspended or terminated:
You may lose access to future Reports and any saved information.
Any outstanding orders will be cancelled.
You may not be entitled to a refund unless required by law (including under the Australian Consumer Law).
11.4 Termination does not affect any rights or obligations that accrued before termination.
12. Unfair Contract Terms
12.1 In accordance with the unfair contract terms provisions of the Competition and Consumer Act 2010 (Cth), Schedule 2 (Australian Consumer Law), these Terms are drafted to be fair and transparent.
12.2 If any term in these Terms is found to be unfair within the meaning of Division 1, Part 2-3 of the Australian Consumer Law, that term is void and unenforceable. The remaining Terms continue in full force and effect.

13. Governing Law and Jurisdiction
13.1 These Terms are governed by and construed in accordance with the laws of New South Wales and the Commonwealth of Australia, without regard to conflict of laws principles.
13.2 Any dispute, claim, or legal proceeding arising from or relating to these Terms, the Website, or a Report is subject to the non-exclusive jurisdiction of the courts of New South Wales, the Federal Court of Australia, and the courts of Australia generally.
13.3 You irrevocably submit to the jurisdiction of those courts and waive any objection based on forum non conveniens or any other ground.
14. Amendments to These Terms
14.1 These Terms may be updated at any time. Changes will be posted on the Website with an updated "Last updated" date.
14.2 Your continued use of the Website or purchase of Reports after an update constitutes your acceptance of the amended Terms.
14.3 If you do not agree with any amendment, you should cease using the Website immediately.
15. Entire Agreement and Severability
15.1 These Terms, together with the Disclaimer and Privacy Policy, constitute the entire agreement between you and Eprotech Pty Ltd regarding the Website and Reports, and supersede all prior or contemporaneous communications.
15.2 If any clause or part of these Terms is found to be invalid, unenforceable, or void (including under the unfair contract terms provisions of the Australian Consumer Law), that clause will be severed and the remaining Terms will continue in full force and effect.
15.3 Failure to enforce any right or provision does not constitute a waiver of that right or provision.
15.4 These Terms do not create any agency, partnership, joint venture, or employment relationship between you and us.
16. Dispute Resolution
16.1 If a dispute arises in connection with these Terms, the Website, or a Report, both parties agree to first attempt to resolve the dispute through direct negotiation in good faith.
16.2 If the dispute cannot be resolved through negotiation within 30 days, either party may:
(a) Refer the matter to mediation administered by the Australian Disputes Centre (ADC) or another agreed mediator; or
(b) Commence legal proceedings in the courts of New South Wales.
16.3 Nothing in this clause prevents either party from seeking urgent interlocutory or injunctive relief from a court of competent jurisdiction.
16.4 Each party will bear their own costs for dispute resolution, unless otherwise ordered by a court or agreed in writing.
17. Force Majeure
17.1 We are not liable for any delay or failure to perform any obligation under these Terms if the delay or failure is caused by circumstances beyond our reasonable control, including but not limited to:
Natural disasters, pandemics, or public health emergencies.
Government actions, legislative changes, or regulatory orders.
Internet, network, or telecommunications failures.
PPSR, NEVDIS, or other government system outages or unavailability.
Cyberattacks, hacking, or system security breaches caused by third parties.
Industrial disputes, strikes, or supply chain disruptions.
17.2 In the event of a force majeure event, we will use reasonable efforts to minimise the impact and resume normal operations as soon as practicable.
