Introduction

This Disclaimer applies to the website revscheckreport.au ("Website") and all reports, content, and services provided through it. By accessing the Website or purchasing a REVS check / PPSR vehicle history report ("Report"), you accept the terms set out in this Disclaimer. If you do not agree, please do not use the Website.

This Disclaimer should be read together with the Website's Terms and Conditions and Privacy Policy, which together form the complete agreement between you and Eprotech Pty Ltd (ABN: 43 644 335 535 / ACN: 644 335 535) ("we," "us," "our," or "Company").

Important: Reports are for information only and do not constitute legal, financial, or mechanical advice. Always obtain independent professional inspections and advice before purchasing a used vehicle.

About Our Reports

RevsCheckReport.au provides digital vehicle history reports at $2.00 AUD per report, based on data from the Australian Personal Property Securities Register (PPSR) and related government databases (such as NEVDIS). These Reports are intended to help you research a vehicle's encumbrance status, written-off status, and stolen status before purchase.

Reports are generated by retrieving data from official PPSR search certificates issued under section 174 of the Personal Property Securities Act 2009 (Cth) and government vehicle records. We act as an intermediary to compile and present this information in an easy-to-read format. We do not own or control the data in PPSR or government databases, and we do not modify or alter the information returned by those systems.

No Professional Advice

The Reports and content on the Website are provided for information purposes only. They are not, and should not be treated as:

Professional legal advice.

Financial advice or financial product advice.

Mechanical advice, vehicle inspections, or condition assessments.

Property valuations or market appraisals.

Legal opinions on title, ownership, or encumbrances.

What You Should Do Before Purchasing a Used Vehicle

Obtain a professional mechanical inspection from a qualified mechanic or motor engineering specialist.

Seek independent legal advice if you have concerns about vehicle title, ownership, encumbrances, or your legal rights as a buyer.

Seek independent financial advice if you are financing the purchase or considering the vehicle as an investment.

Conduct your own due diligence and independently verify all important information before making a purchase decision.

Check the vehicle in person and inspect its condition, history, service records, and documentation.

Verify vehicle identifiers — confirm that the VIN on the vehicle matches the VIN on the registration papers and the compliance plate.

You are responsible for making your own purchasing decisions based on all available information, including but not limited to Reports. Do not rely solely on Reports when deciding whether to purchase a vehicle.

Data Sources and Accuracy

Reports are generated using data from the following sources:

Personal Property Securities Register (PPSR)

An official Australian government register operated by the Australian Financial Security Authority (AFSA). PPSR records security interests (such as outstanding finance) registered against personal property, including vehicles. PPSR searches are conducted under Part 5.5 of the Personal Property Securities Act 2009 (Cth).

NEVDIS (National Exchange of Vehicle and Driver Information System)

A system operated by Austroads and state/territory transport authorities that holds vehicle registration, written-off vehicle, and stolen vehicle data.

Third-Party Government Data Sources

Related databases and registries that record vehicle incidents, written-off status, stolen reports, and other vehicle history information.

Accuracy Limitations

These government and third-party databases may contain errors, delays, omissions, or outdated information. They operate independently from RevsCheckReport.au and are subject to their own data limitations and update cycles.

While reasonable efforts are made to provide current and accurate information, no guarantee is made that:

All information in a Report is complete, accurate, current, or up-to-date.

Government or third-party databases are error-free, comprehensive, or fully maintained.

Reports will be available or delivered within specific timeframes (delays may occur due to external systems being offline, network issues, government database maintenance, or high demand).

Information will not change between the time you receive a Report and the time you use it to make a purchase decision.

All relevant vehicle history information is recorded in PPSR or other databases (for example, some incidents may not be reported or registered, and some finance arrangements may not be recorded on PPSR).

You should not rely solely on Reports when making decisions about a vehicle purchase. Always independently verify important information, especially regarding finance, title, ownership, and vehicle condition.

User Responsibilities

You are responsible for:

Providing accurate and complete information when requesting a Report, including the correct Vehicle Identification Number (VIN), registration number (licence plate), and state or territory of registration.

Checking and verifying that the Report returned relates to the correct vehicle before relying on it.

Supplying information you know to be accurate at the time of your request.

Entering vehicle details carefully and double-checking them before submitting a search request.

Input Errors

If you provide incorrect information (such as a wrong VIN, incorrect registration number, or wrong state), the Report generated may be incomplete, inaccurate, or relate to a different vehicle. We are not responsible for any losses, damage, or incorrect purchasing decisions arising from your input errors. It is your responsibility to verify that the Report relates to the correct vehicle.

Tip: If you are unsure of the correct VIN or registration details, verify them with the vehicle seller, the vehicle's compliance plate, or the relevant state/territory transport authority before purchasing a Report.

Limitation of Liability

To the extent permitted by Australian law, our liability to you for any claim arising from use of the Website or Reports is limited as follows.

What We Are Not Liable For

We are not liable for:

Any errors, omissions, inaccuracies, or delays in Reports or Website content.

Any loss or damage (including direct, indirect, incidental, special, or consequential loss) arising from your use of, or inability to use, the Website or Reports.

Any loss or damage arising from your reliance on the accuracy, completeness, timeliness, or interpretation of information in Reports.

Any loss or damage arising from technical failures, system downtime, network outages, or unavailability of the Website or servers.

Any loss or damage arising from external system failures or unavailability, including PPSR, NEVDIS, payment gateways, or government database outages.

Any loss or damage arising from third-party services (such as payment processors, hosting providers, analytics platforms, or government systems) or their performance.

Loss of profit, revenue, opportunity, data, or goodwill, even if we have been advised of the possibility of such loss.

Any incorrect purchasing decisions made based on information in Reports.

Non-Excludable Rights Under Australian Consumer Law

Nothing in this Disclaimer excludes or limits any rights you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded by law. These non-excludable rights include:

Consumer guarantees that services are of acceptable quality and fit for the purpose for which they are supplied.

Consumer guarantees that services are provided with due care and skill.

Consumer guarantees that services will be completed within a reasonable time.

Your rights to seek remedies for misleading or deceptive conduct under section 18 of the ACL.

Important: As confirmed by Australian courts, parties cannot contract out of liability for misleading or deceptive conduct under section 18 of the ACL (Viterra Malt Pty Ltd v Cargill Australia VSCA 157). This Disclaimer does not, and is not intended to, exclude or limit rights that cannot be lawfully excluded.

To the extent the Australian Consumer Law allows, if we breach a non-excludable consumer guarantee, our liability is limited to:

(a) The cost of resupply of the services; or

(b) Refund of the price paid for the Report.

Disclaimer Is Not a Defence to Misleading Conduct

This Disclaimer is provided for transparency and to set reasonable expectations about the nature and limitations of our services. Under Australian law, a disclaimer is not effective if it contradicts the main representation being conveyed, and it cannot be relied upon as a defence to misleading or deceptive conduct. All claims and representations made on the Website are intended to be accurate, honest, and not misleading.

Government Database Limitations

You should be aware of the following limitations of the data sources used to generate Reports:

PPSR Limitations

PPSR records only registered security interests: PPSR does not record all debts or financial arrangements. Some outstanding finance may not be registered on PPSR. Conversely, some PPSR entries may be old, incorrectly entered, or no longer relevant.

Registration vs. registration: PPSR "registration" refers to registration of a security interest on the register — not vehicle registration (number plate). These are distinct concepts.

Written-Off Vehicle Limitations

A vehicle may be recorded as written off in government systems if it has been damaged and assessed as uneconomical to repair (statutory write-off) or repairable (repairable write-off).

However, not all damaged vehicles are reported as written off, and not all written-off records are up-to-date.

Written-off vehicle data is sourced from state/territory transport authorities and insurers, and recording practices may vary between jurisdictions.

Stolen Vehicle Limitations

A vehicle may be recorded as stolen if reported to police. However, not all stolen vehicles are immediately reported or recorded, and some records may relate to vehicles that have been recovered or incidents that have been resolved.

Update Delays

PPSR, NEVDIS, and other government systems may have delays in recording, updating, or removing information. Information in these systems may lag behind actual events by days or weeks.

Data Accuracy

Government databases rely on information supplied by third parties (such as finance companies, police, insurers, and transport authorities). Errors in source data may be reflected in PPSR or government records.

If you believe information in a PPSR or government database is incorrect, contact the relevant authority directly: AFSA for PPSR matters (www.ppsr.gov.au), or NEVDIS/your state transport authority for vehicle registration data (nevdis@nevdis.com.au).

You should never assume a vehicle is free of issues simply because no records appear in a Report. Conversely, you should seek clarification before assuming a vehicle has issues based solely on a Report.

Third-Party Websites and Services

The Website may contain links to third-party websites, and third-party services are used for payment processing (Stripe and PayPal), analytics (Google Analytics), hosting, and email delivery.

We are not responsible for:

The accuracy, content, products, services, or policies of any third-party website or service.

Any loss or damage arising from your use of those websites or services.

Any data breaches, security failures, or compliance failures of third-party providers.

Any changes to the terms, policies, or services of third-party providers.

You should review the terms of use and privacy policies of any third-party website or service before using them or providing information to them. Payment processors (Stripe, PayPal) and analytics providers (Google Analytics) are responsible for their own data handling and security.

External System Outages and Delays

From time to time, PPSR, NEVDIS, government databases, payment gateways, or Website infrastructure may be unavailable due to:

Scheduled or emergency maintenance.

Technical failures or system upgrades.

Network issues or connectivity problems.

Government system outages or updates.

High demand or system overload.

Reasonable efforts will be made to minimise downtime and notify users of planned maintenance where practicable. However, continuous or uninterrupted availability of the Website or Reports is not guaranteed. We are not liable for any loss or damage arising from Website unavailability, Report delivery delays, or failures of external systems.

No Warranties

Except as expressly stated in these terms or as required by the Australian Consumer Law, no warranties, representations, or guarantees are made regarding the Website, Reports, or any content provided. The Website and Reports are provided on an "as is" and "as available" basis.

This does not affect your non-excludable rights under the Australian Consumer Law.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Eprotech Pty Ltd, its directors, officers, employees, and agents from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of or in connection with:

Your use of the Website or Reports.

Your breach of the Terms and Conditions or this Disclaimer.

Your provision of incorrect information when requesting a Report.

Your reliance on Report content for purchasing decisions without obtaining independent professional advice.

Any third-party claim arising from your misuse of Reports or Website content.

This indemnity does not apply to the extent that the relevant claim arises from our negligence, wilful misconduct, or breach of the Australian Consumer Law.

This Disclaimer may be updated at any time to reflect changes in business practices, technology, legal requirements, or data sources. Changes will be posted on this page with an updated "Last updated" date.

Your continued use of the Website or purchase of Reports after changes are published constitutes your acceptance of the updated Disclaimer. If you do not agree with any amendment, you should cease using the Website immediately.

Where material changes are made, reasonable steps will be taken to notify users (such as by posting a prominent notice on the Website).
